Limitation of Liability:  EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW AND THEN ONLY TO THAT EXTENT, IN NO EVENT WILL 9DOLLARDOMAINS.COM, ITS EMPLOYEES, OFFICERS, DIRECTORS, AFFILIATES OR AGENTS BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE OR INCOME, LOST PROFITS, PAIN AND SUFFERING, EMOTIONAL DISTRESS, COST OF SUBSTITUTE GOODS OR SERVICES, OR SIMILAR DAMAGES SUFFERED OR INCURRED BY YOU OR ANY THIRD PARTY THAT ARISE IN CONNECTION WITH THE WEBSITES OR SERVICES (OR THE TERMINATION THEREOF FOR ANY REASON), EVEN IF 9DOLLARDOMAINS.COM HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  9DOLLARDOMAINS.COM SHALL NOT BE RESPONSIBLE OR LIABLE WHATSOEVER IN ANY MANNER FOR ANY CONTENT POSTED ON THE WEBSITES OR SERVICES (INCLUDING CLAIMS OF INFRINGEMENT RELATING TO CONTENT POSTED ON THE WEBSITES OR SERVICES, FOR YOUR USE OF THE WEBSITES AND SERVICES, OR FOR THE CONDUCT OF THIRD PARTIES WHETHER ON THE WEBSITES, IN CONNECTION WITH THE SERVICES OR OTHERWISE RELATING TO THE WEBSITES OR SERVICES. NOTWITHSTANDING THE ABOVE, YOU AGREE THAT IN ALL SITUATIONS, 9DOLLARDOMAINS.COM'S TOTAL LIABILITY FOR ANY LOSS, IS LIMITED TO A REFUND OF FEES PAID, REGARGLESS OF HOW CAUSED, INCLUDING, BUT NOT LIMITED TO, EQUIPMENT FAILURE, NEGLEGENCE, OR ANY OTHER FAILURE OF ANY TECHNOLOGY OF PERSONNEL MANNER.

About our low prices:  We keep prices low by keeping things simple and by dealing in bulk.  Obviously the only way to register domain names for prices like $6.99 or $8.99 or $9.99 rather than the $29-$35 many other companies charge is to do a lot of them, and to keep the setup as similar as possible across as many customers as possible.  This ensures both the best consistent quality service and keeps our prices as low as possible.

We also keep our costs down by paying for our registrations to our upstream registrars at the time of registration.  This is a requirement the Registrars, including ICANN (.COM / .NET / .ORG / .CC) & CIRA (.CA Canadian). For this reason, payment is due by Credit Card or PayPal when services are rendered, and once processed there simply are no refunds.  You can, of course, cancel or transfer your hosting at any time, so you are never locked in or contracted longer than your currently paid up period.

Domain Name Registrations for only $6.99 refers to US$ funds for new .com / .net / .org registrations with hosting orders, and as advertised there are no additional charges to pay to InterNic or Network Solutions or any other outside registrar or agency. Other worldwide domains like .INFO, .NET, .CC. US or .CA (Canadian) may vary in price.  We currently can assist in the registration of over 115 different top level domains.  Since we incur charges and pay for your registrations at the time of registration, these fees are non-refundable once processed.  However, since there are no contracts, the initial charges is all you'd ever have to pay us if you decided to cancel or transfer your registration and/or hosting. (Please note:  Some international domains are registered with our account information and we act as liaison to the international registration agency on your behalf.  Again, we do this at no additional charge.  However, if you wish to set-up your own account with the international governing body and transfer your registration to that account, they may well charge you an additional fee or an additional year's registration to do so.)

About our hosting:  We setup your account and we assume you want to renew your hosting, so you will be automatically billed on the anniversary for an additional period at our then current annual rate, unless of course you decide not to.  It is YOUR RESPONSIBILITY to cancell you billing. Since domain registrations & renewals are governed by different registries around the world, it is your responsibility to ensure your domain(s) are renewed and even if your domain expires, we will renew your hosting unless you let us know you don't want it.  If you are going to cancel, please let us know at least 22 days before your expiry date on annual contracts so we can ensure an error free transition.  If we are not notified at least 22 days in advance, we can not guarantee we'll be able to stop the next charge in time.  Once these charges are processed, we can not issue a refund, so make sure you let us know.  The charges get transmitted and processed in batches, so you must let us know at least 22 days before your anniversary date if you are not going to be renewing.  The above may sound dire, and it's not designed to scare or trap anyone into anything.  We just want to make sure you understand that Hosting is a subscription based service sort of like your television service or your Telephone service.  The cable TV company or Telephone company doesn't call you ever month to check you if you still want service this month, they instead assume that you do and renew you until you let them know otherwise.  As well, simply unplugging your TV (or if the Television breaks and is in the shop) doesn't somehow let the cable TV company know you no longer want Cable TV service.  It's the same with hosting and we'll renew your hosting until you let us know otherwise, regardless of the status of your domain name renewal itself, or of your Internet connectivity status with your ISP or if your computer is broken or any other factors.  If you want to cancel, just let us know.  :-) 

Finally, our offer states that you don't have to pay InterNic's fee, which is of course true.  The fees you pay us to register a name is all you'll pay, as long as your registration & renewals are with us.  Also, since you can cancel at any time, choosing to do so and releasing the name at the end of the registration period would mean that initial registration fee is all you'd ever have to pay for registration.

However, if you choose to transfer your registration to some other company, there of course may be additional setup and/or registration fees that you may have to pay in that process.  We don't know what charges other companies may charge for their setup, plus you may have to start paying an annual renewal fee to keep you name or other fees that company may charge for their services.  This is fairly straight forward and obvious, but so that there is no confusion we wanted to mention it in our terms.  Obviously, our low costs for registration and/or hosting only apply to our customers and do not imply some universal, Internet wide policy.  :-)


About Registrations & Renewals: Requesting Domain Name(s) Registration or Renewal does not necessarily mean that the Domain Name(s) will always be successfully registered or renewed.  IT IS YOUR RESPONSIBILITY TO CHECK ON THE STATUS OF ANY REGISTRATION OR RENEWAL ORDER PLACED WITH US, TO ENSURE THAT IT IS PROCESSED PROPERLY AT THE REGISTRY.  There may be technical issue - for example more than one request for the same Domain Name(s) via different registrars, or the name may have even been registered recently and not yet updated in the WHOIS database, or a communication fault while our system transmits a registration or renewal request upstream.  If this is the case, it is possible for Registrations or Renewals to seem to have processed correctly, but to have failed due to some technical failure.  Also, policy changes by ICANN, CIRA or Verisign may impact the registration or renewal of Domain Name(s).  In almost all cases, this is a non-issue, however very occasionally a name will show up as being available for registration, or will show up as being sucesfully renewed, only to find out that some technical issue - such as the name is simultaneously being registered somewhere else - has cauesd a failure in the process.  IN ANY EVENT, OUR LIABILITY IS LIMITED TO THE REGISTRATION OR RENEWAL PRICE PAID TO US, AND YOU AGREE TO ASSUME THE RISK AND TO HOLD US HARMLESS FROM ANY ACTION, HOWEVER CAUSED.

About Expiration / Redemption Status: When a domain comes to the end of it's current Registration Period, and approaches it's expiration or renewal date, emails will be sent by us as well as often by the Registry itself notifying the domain registrant of the upcoming renewal.  If a domain name is not properly renewed on time, it can enter various status which vary by domain type, but they usually include 'Expired', 'Redepmtion' and 'Pending Delete' status.  It is important to note that even if you have requested renewal for the domain, and/or even if you have paid for a renewal invoice, IT IS STILL YOUR RESPONSIBILITY TO CHECK IN THE WHOIS DATABASE ON THE STATUS OF ANY REGISTRATION OR RENEWAL ORDER, TO ENSURE THAT IT IS PROCESSED PROPERLY AT THE REGISTRY. There can be reasons where a normally-automated domain registraion or renewal process doesn't function - for example, it's possible for you to pay for an invoice while a domain is in 'Expired' status, yet the domain may not be renewed because it is expired, and may still continue into 'Redemption' status.  Also, transient communications issues between a Registrar and the Registry may result in a failure to properly renew a domain, so it is important for you to check the status in the WhoIs database and to ensure that all your domains are properly Registered or Renewed as expected.

A domain with the status “REDEMPTION PERIOD” or “PENDING DELETE RESTORABLE” was not renewed, and has been expired for some time. When most domains types expire they go into a post-expiration grace period that vary by domain type that usually lasts for 40 days.  During this period, various emails and warnings are sent by the registry indicating it's Expired Status.  Also, during this Expired Status, any website or email associated with the domain will not fuction, so ample notice is given by 9DollarDomains.com and by the Registry itself to notify the contacts that the domain is in Expired Status.  Domains which are not renewed during their grace period are partially deleted, after which point the central Registry will hold the domain in the REDEMPTION PERIOD/PENDING DELETE RESTORABLE for and additional 30 days.  At this point, 9DollarDomains.com does not have the contact information associated with this domain since it was deleted by the central Registry.  However, you can see its current status by using a Registry-level WHOIS.

Before the domain expires, attempts are made to email the various contact email addresses on the domain name. For this reason, it’s important to keep the contact information up to date. The requirement to have valid contact information on the domain was also highlighted in the agreements made when the domain was first registered. Important information is sent to these contacts, and having an invalid email address or aggressive SPAM filters may prevent delivery of these messages.
The Registry-imposed REDEMPTION PERIOD/PENDING DELETE RESTORABLE state usually lasts for 30 days, and during this period it is still possible to recover a domain in this state, however fees in excess of $250 to $300 per domain are typically incurred in order to redeem a domain from 'Redemption Status'.  The domain can only be redeemed by the original owner of the domain as listed on the WHOIS prior to the deletion, so do not contact 9DollarDomains or Tucows if you are not the original listed owner of the domain.  Redeeming a domain is more time consuming and more expensive and more complicated than if the domain was renewed prior to expiration.

Note: At the end of the grace period, some domain names may be sold in an auction system before they enter the redemption period. If the domain name is sold at auction, it will not be available for re-registration.  Therefor, if a domain does go into Redemption status, the only way for the original domain owner to ensure that they recover their domain is to redeem the domain from Redemption status - which can cost $250 to $300 or more per domain.  That being said, many domains will simply be deleted and released back to the public, and it is possible for those domains to be registered like new domains again.  However, that also runs the risk of the domain being sold at auction, or the risk or someone else simply beating you to the draw when the domain is deleted and released to the public.

IT IS IMPORTANT TO KEEP YOUR CONTACT EMAIL UP TO DATE, AND IT IS YOUR RESPONSIBILITY TO CHECK IN THE WHOIS DATABASE ON THE STATUS OF ANY REGISTRATION OR RENEWAL ORDER.  OUR LIABILITY IS LIMITED TO THE REGISTRATION OR RENEWAL PRICE PAID TO US, AND YOU AGREE TO ASSUME THE RISK AND TO HOLD US HARMLESS FROM ANY ACTION, HOWEVER CAUSED.


About our E-Mail List:  We run an Opt-in / Opt-out mailing list that allows people to choose to subscribe or un-subscribe to our list, and we periodically (once every month or so) send mail to these people about our latest specials or other important news.  If someone no longer wants to get these messages, they simply have to reply and ask to be removed, or they can visit our site and submit an email address they want added or removed from the list.  We honor all add and remove requests.  As a matter of fact, since most add and remove requests come in via email or the online form, our automated system does them for us.  This makes it easy and convenient for us, and simple and convenient for our customers to add and remove themselves and their associates.


About our Referral Program:   We MOST CERTAINLY DO want to encourage you to spread the word about our fantastic prices and services and WE DO want you to refer others to register & host their domains with us.  If you do so, we'll reward you with a credit for up to $9 for every person that you recommend that purchases a hosting package from us. UCE (SPAM): When it comes to referrals, however, we DO NOT ALLOW SPAM!   More technically, it is called "UCE" (or Unsolicited Commercial Email) but simply put, you ARE NOT ALLOWED to bulk email everyone under the sun, or to bulk post to every newsgroup everywhere.  That's SPAM, and it's not only against our 'Terms and Conditions', it's illegal and just plain rude as well.

Please understand, we're not saying that you are not allowed to email this offer to people, or that you shouldn't post it in an appropriate newsgroups, because you most certainly can, but only if it's 'solicited' (requested) or clearly on topic. For example, if you are in newsgroup called alt.low.cost.hosting, where people are supposed to discuss their favorite low cost host, then it would probably be very appropriate to post a message about us there.  Likewise, if your site includes a link that says "Give us your email, and we'll let you know about a great hosting offer!", then by all means, let those people know about us.  However, if you bulk post a generic message from alt.alpha to zymurgy.zoo across some news server, or if you send a bulk email to everyone on the planet, then that will get you in trouble.

Besides, there are other, much more effective ways to get the word (such as encouraging people to visit your site and using a link to ours, or by allowing people to sign-up to a mailing list that you can then mail to.)  If you do Spam, you will not be eligible for the referral benefits, and / or you will have your hosting account terminated without refund.  Plus the person or people you Spam may be upset enough that you may find yourself liable for civil penalties directly from then.  Spread the word about our great prices and services, but do it within the bounds of our terms and conditions and within the law, please.  :-)


Acceptable Hosting Use:  Our services can not be used for: a) Obscene photographs, images or articles involving such things as extreme violence, bestiality and pornography; b) Indecent photographs or indecent pseudo-photographs of a child; c) illegal activity.


About Hits / Traffic / Storage Quotas:  Hit's and traffic are technically unlimited, but according to fair use rules. In order maintain quality service for everyone, sites with extraordinary activity, or sites with activity that adversely affects the performance of other sites may be priced separately. With almost no exceptions, normal Websites will never exceed our guidelines unless a personal site is used as a reseller site, or as a file-sharing site - which is not what they are intended for.


Our Universal Disclaimer:  In a nutshell, our disclaimer says the Internet is unpredictable and unreliable and we can't guarantee anything Internet related.  The extent of our liability is limited to a refund of the price paid to us for services that we were unable to render.  For example, requesting that we register or renew Domain Name(s) for you does not mean that the Domain Name(s) will necessarily be successfully registered or renewed. There may be more than one request for the same Domain Name(s) via different registrars, or technical difficulties or delays with our servers, with automated CGI's or with the Internet itself may hamper the registrations or renewals in some way.  There may also be laws or rules governing the different registries that may make it impossible to register Domain Name(s) that otherwise show as available.  As well, policy changes from ICANN, CIRA, Verisign or other upstream registrars may result in the non-renewal or loss of your domain names.  If the Registry informs our system that we are able to register the requested Domain Name(s), we will register your Domain Name(s) and your account will be charged for the registration fee.  If we are unable to register your Domain Name(s) for any reason, our liability is limited to refunding you your registration fees paid.  You alone accept the responsibility and liability and assume all risk and agree to hold us harmless.  By using our services, you agree to these terms, and specifically to this disclaimer.  If you do not agree, then do not use our services.


CREDIT CARD POLICY:

1) Customer Support:  Please open a Support Ticket, or email support@9dollardomains.com. In order to keep prices low, we do not provide a toll-free phone number.  :-)  
2) Delivery of Services:  New Domain Registrations are usually active within 2 - 4 hours, and hosted sites are usually online as soon as the WHOIS info is propagated, which is usually within 4 hours.
3) Export Restrictions: Our Domain name registration and Hosting services are available worldwide.
4) Country of Location: We have servers located in Saskatchewan, Canada. and in Maryland, California and Texas USA.
5) Currency of Services: Transactions on this site are completed in American funds, and will be converted to your native funds if you are not American.
6) Refunds:  Since services are rendered at the time the transactions, once a transaction is processed, there are no refunds.
